DMCA Policy

Overview

Ediigo respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to valid copyright infringement notices and take appropriate action as required by law.

Copyright Infringement Notification

If you believe that content on our platform infringes your copyright, please provide our designated DMCA agent with the following information:

Required Information:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, including its location on our platform
  • Your contact information (address, telephone number, and email address)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification Process

If you believe that your content was removed due to a mistake or misidentification, you may submit a counter-notification with the following information:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  • Your name, address, telephone number, and consent to jurisdiction of the federal court in your district
  • A statement that you consent to service of process from the person who provided the original DMCA notification

Note: Filing a false counter-notification may result in legal liability. Consider consulting with an attorney before submitting a counter-notification.

Our Response Process

Upon Receiving a Valid DMCA Notice:

  1. We will promptly remove or disable access to the allegedly infringing content
  2. We will notify the user who posted the content about the removal
  3. We will provide the user with a copy of the DMCA notice
  4. We may suspend or terminate accounts of repeat infringers

Upon Receiving a Valid Counter-Notification:

  1. We will forward the counter-notification to the original complainant
  2. We will inform them that we will restore the content in 10-14 business days
  3. We will restore the content unless the complainant files a court action seeking an injunction

Repeat Infringer Policy

We maintain a policy of terminating accounts of users who are repeat copyright infringers. Our policy includes:

  • Tracking DMCA notices received for each user account
  • Warning users after their first infringement notice
  • Suspending accounts after multiple infringement notices
  • Permanently terminating accounts of confirmed repeat infringers

False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. We reserve the right to seek damages from any party that submits a false DMCA notification or counter-notification.

Safe Harbor Compliance

Ediigo qualifies for safe harbor protection under the DMCA as a service provider. We do not monitor user content for copyright infringement, but we respond promptly to valid DMCA notices and maintain appropriate policies regarding repeat infringers.

Preservation of Content

When we remove content in response to a DMCA notice, we may preserve a copy for potential restoration in case of a valid counter-notification. This preserved content is not publicly accessible and is used solely for DMCA compliance purposes.

Non-US Copyright Issues
